POSTING AGREEMENT

This Agreement describes the terms under which TRADEATTACHE. Com™, Inc. (TRADEATTACHE) will provide your company (Client or You) with an enhanced ( i.e. Gold & Silver ) listing or listings (Listing). Please review it carefully before posting your Listing onto the site.

You and TRADEATTACHE agree as follows:

  1. Base Service Package. You have the required authority on behalf of your company and wish to post the Listing indicated above, in the TRADEATTACHE directory.
  2. Payment. After the expiration of any promotional free listing period You agree to pay for the selected Base Service Package on monthly basis, in advance, by credit card, or monthly automatic withdrawal from your bank account. You hereby expressly authorize TRADEATTACHE to charge your account for the Base Service Package, each month, without any further authorization from you, for as long as your service continues.
  3. Termination. Either TRADEATTACHE or You may terminate this Agreement at any time and for any reason, without prior notice. In which case TRADEATTACHE will remove your Listing by the end of the month which is in effect on the third (3rd) business days after the termination. TRADEATTACHE will stop charging your account at the same time the Listing is removed. You understand and agree that You will still be responsible for any charges You incurred prior to the removal of your Listing.
  4. Limitation of Liability. TRADEATTACHE shall not be liable for any loss, claim or other damages, resulting from or related to:
    (1) TRADEATTACHE’s termination of this Agreement
    (2) any inability of TRADEATTACHE to perform services in accordance with the applicable Base Service Package for any reason including without limitation, technical, labor, power difficulties or civil disturbance occurring during such periods as TRADEATTACHE is providing services to Client. TRADEATTACHE is a website provider and not a publisher of any features, content or contributions, including without limitation those selected or used by Client or any other client or participant or about any subject matter. Client acknowledges that TRADEATTACHE expressly disavows any responsibility for the content of materials or information provided by or about any client, participant or subject matter. Notwithstanding the foregoing, TRADEATTACHE reserves the right to remove or refuse to post content on the Web Site in TRADEATTACHE’s sole discretion.   5. Changes, Modifications, Amendments. TRADEATTACHE at its sole and absolute discretion, may change, modify and/or amend any of the terms of this agreement, "Terms of Use" of the site, the designs and looks of the site or anything contained therein, the technologies it uses, its service providers, any of the services it offers including Listings, or the pricing levels for such services, at any time and without prior notice to Client. Client understands and agrees that TRADEATTACHE’s only liability to Client in such cases is limited to the amount of Client’s charges for the immediate past Thirty (30) days from the date upon which Client provides written notice to TRADEATTACHE that he disputes such changes, amendments or modifications.
  6. Miscellaneous. This Agreement together with the "Terms of Use" contains the entire understanding of the parties and supersedes any and all prior and contemporaneous communications. This Agreement shall be governed by and construed in accordance with California law and exclusive jurisdiction and venue shall be in the federal and state courts in the County of Los Angeles. If any provision of this Agreement shall be determined to be invalid or unenforceable, such provision shall be deemed severed and the remainder of the Agreement shall remain in full force and effect.
